You represent that you are a bona fide Travel Agent and posses required certification and are authorized to use this Website and to create binding legal obligations for any liability You may incur as a result of the use of this Website. The online booking done on this website does not imply a final confirmation or commitment by Westend Travel to deliver the product reserved at the prices indicated. Westend Travel will do all efforts to provide current and accurate information on website, however errors may occur and Westend Travel reserves the right to change the prices, taxes, fees, charges if happened due to price changed by airlines or suppliers without any notice or liability to the user or any other person. Westend Travel cannot guarantee that prices advertised on the website as the product may not be available at the time of booking or ticketing therefore Westend Travel reserves the right at any time to reject, amend, cancel or terminate any order without prior notification.

All Fares, Taxes, Fees, Surcharges are:

• All ticketing request must be done within office working hours and day with reasonable time to issue tickets before any deadline imposed by the fares rules, airlines or service providers.
• In the event that more than one set of conditions apply to the same booking then the most restrictive conditions of both sets apply to the entire journey.

You are responsible for advising the passenger of all fare restrictions, terms and conditions and ensuring the passenger is fully aware of the travel documents and visas necessary for any itinerary which you book through this Website.

Reservations are subject to space availability in the appropriate class at the time of booking. You are responsible for ensuring that full payment is received by Westend Travel and reserves its right to refuse to issue Tickets if full payment has not been received. Tickets will be issued after re-pricing for fares and taxes applicable before issuance in accordance with the current rules established by the applicable carrier or supplier.

Tickets issued in association with the fares listed are governed by the rules of the carrier on whom the ticket is issued. Schedules are subject to change without notice. It is the responsibility of passengers to reconfirm flight times as instructed. The carrier assumes no responsibility to the passenger for any loss, delay, or other inconveniences incurred in connection with any flights. Please contact the relevant airline directly for information on baggage allowances, liabilities, passenger rights, and conditions and for any other airline specific terms and conditions.

All booking must be paid in Full by Certified agency check, Major credit cards if airlines or suppliers accept the credit card before issuing the tickets, or any other arrangement You had in place with Westend Travel.

You must submit Westend Travel credit card authorization form while registering online and accepting these conditions you are authorized to use your client's Credit Card number that indicates your acceptance of our booking terms and conditions, whether or not your clients have actually signed the appropriate draft. The credit card used must belong to one of the passengers in the reservation.

Third party Credit Cards will absolutely not be accepted. If the airline does not accept payment by credit card, however the client wishes to use a credit card our merchant services can be used for a fee determined at the time of booking.

You agree that all payments made by credit cards are the responsibility of your travel agency by purchasing and paying travel products electronically on this Website. You must adhere current IATA Resolution 890 and reasonable due diligence must be carried out including original signed UCCF forms to be retained by You to protect Westend Travel in the event of a charge-back from credit card companies. Westend Travel will not be responsible for payment of any charge-backs by the cardholder due to any dispute or reason and You agree to provide all original documents immediately or failure to do that will remits any charge back amount immediately.

All tickets must be cancelled prior to original departure date by calling Westend Travel and subject to the airlines rules and conditions, most of the airlines imposed time limitation to cancel the bookings at least 72 hours or earlier before the departure time and this rules must be adhered for cancellations. If cancellation request is outside business hours than agent may cancel booking by contacting the airline directly, if it’s permitted? All cancellations are subject to an administrative charge, commission recall and any applicable airline cancellation charges.

Tickets may be voided same day within office working hours of issuance if allowed by the airlines and GDS system and subject to administrative charges and You MUST call Westend Travel to void the ticket.

By using the Website, You fully waive and release Westend Travel and its members, managers, directors, officers, partners, employees, agents, representatives and licensors from any and all claims, demands, losses and damages of every kind and nature, whether known or unknown, arising out of or in any way relating to the booking on this website , use of the website by You and other users, and any dispute or defence You have or claim to have against Westend Travel or one or more users of the website.

In no event will westend travel inc., its directors, members, managers, officers, employees, agents and representatives be liable for any indirect, consequential, special, punitive or incidental losses or damages, including but not limited to loss of business or lost profits, business interruption or loss of business information, incurred by you or any third party, regardless of the form of action, whether in contract, tort or otherwise, and regardless of whether the cause of action arises from use of the website or any action or failure to act by westend travel, even if westend travel has been advised of the possibility of such damages or loss. In no event shall westend travel liability hereunder exceed the amounts paid by agent to westend tarevl solely with respect to the matter giving rise to such liability.

Westend travel is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any carriers, or any other suppliers for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Westend travel has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

In the event any provision of these Terms is held by a court to be invalid, unlawful or unenforceable, the validity, legality and enforceability of the remaining provisions contained in these Terms will not in any way be affected or impaired. Westend Travel failure to exercise or enforce any right or provision under these Terms will not constitute a waiver of such right or provision by Westend Travel, and no single or partial exercise by Westend Travel of any right or remedy precludes other or further exercise thereof or the exercise of any other right or remedy.

These terms shall be governed by the laws of the province of ontario, canada without regard to its conflicts of laws principals. Any case, controversy, suit, action, or proceeding arising out of, in connection with or related to these terms shall be brought in a court located in ontario, canada and you herebywaive any objection to the exclusive jurisdiction of such courts. You hereby consent and submit to the jurisdiction of any court located within said province. You hereby waive any right or basis you may otherwise have to transfer or change or object to the venue of any litigation arising out of, in connection with or related to these terms in accordance with this paragraph.

You agree to indemnify and hold Westend Travel, its managers, members, officers, agents, employees, contractors and principals, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees and costs, due to or arising out of (i) the use of the Website by You; (ii) the breach of these Terms by You, or (iii) the violation by You of any third party right. This indemnification obligation will indefinitely survive these Terms and the termination of the use of the Website.

ENTIRE AGREEMENT:

You agree that these Terms supersede any other agreements between You and Westend Travel with respect to the use of the Website.
